1. Acceptance of These Terms

These Terms and Conditions ("Terms") govern access to and use of the BoardGameNite / BoardGameNite Events website, applications, pages, and related services operated by BoardGamesNMore Inc. ("we," "us," or "our").

By accessing the site, creating an account, creating or joining an event, using event-management features, registering for a table or session, submitting content, or otherwise using the platform, you agree to be bound by these Terms and by any additional rules, policies, or notices that apply to specific features.

2. Platform Description

BoardGameNite Events is an event and community platform that may allow users to create accounts, browse public events, create or host events, register for events, join waitlists, manage tables or sessions, review gameplay-related records, receive event notifications, and interact with other platform features.

3. Eligibility and Account Registration

You must provide accurate and current information when creating an account or using account-controlled features. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account unless caused by our own misconduct.

You must not impersonate another person, create an account using false identity information in a misleading way, or use another person's account without authorization.

We may require email verification, approval, identity confirmation, or additional information before some features become available.

4. Role-Based Access and Platform Policies

Certain platform features may depend on account role, permissions, operational rules, or internal policy settings. These may include the ability to create events, publish events, manage registrations, collect fees, access administrative tools, create templates, clone events, or use specialized workflows.

Role policies may change over time, and some rights may be limited, suspended, or expanded based on operational, security, moderation, or business requirements.

5. User Conduct

You agree not to use the platform in a way that is unlawful, abusive, fraudulent, threatening, defamatory, harassing, misleading, discriminatory, infringing, or otherwise harmful to us, to the platform, or to other users.

Without limitation, you must not interfere with or disrupt the platform or its security, attempt unauthorized access, post or transmit malware, scrape or extract data in a prohibited manner, use the platform to send spam or deceptive messages, upload content you do not have the right to use, misrepresent event details, or bypass role restrictions or moderation decisions.

6. User-Generated Content

You may submit content such as event titles, descriptions, schedules, profile information, comments, gameplay inputs, or other materials. You remain responsible for the content you submit.

By submitting content to the platform, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and otherwise use that content as reasonably necessary to operate, improve, support, promote, archive, moderate, or secure the platform and the events or services offered through it.

We may remove, restrict, edit, reformat, or refuse content where we believe it violates these Terms, creates risk, causes operational problems, or is otherwise inappropriate for the platform.

7. Event Creation and Organizer Responsibilities

Users who create, host, or administer events are responsible for the accuracy of the event information they publish, including dates, times, venue details, capacity limits, costs, schedules, age restrictions, participation requirements, and any event-specific house rules.

Event creators and organizers are responsible for ensuring that they have authority to organize the event, use the venue, and publish the relevant information. Unless expressly stated otherwise, we are not the organizer of user-created events and are not responsible for the conduct, quality, safety, legality, or performance of those events.

8. Registrations, Waitlists, and Participation

The platform may allow users to register for events, select sessions or tables, join waitlists, confirm attendance, or respond to participation prompts. Registration does not guarantee attendance rights beyond the status shown in the platform and any applicable event rules.

Waitlist movement, seat allocation, payment timing, registration priorities, cutoff rules, and related participation logic may be governed by site settings, organizer rules, payment state, or automated platform logic.

We reserve the right to correct registration errors, capacity issues, duplicated bookings, administrative mistakes, schedule conflicts, or technical problems affecting participation status.

9. Fees, Payments, Refunds, and Cancellations

If the platform offers paid registrations, membership fees, event charges, deposits, or similar payments, additional payment terms may apply.

Unless otherwise stated, prices, currency, taxes, and fee details will be shown at the point of transaction where applicable; payment processing may be handled by a third-party provider; fees may be non-refundable except where required by law or where a stated refund policy applies; and organizers may have event-specific cancellation or refund rules, subject to law and any overriding site policy.

10. Email Notifications and Platform Messaging

By creating an account or using registration-related features, you agree that we may send you operational communications related to your account and your use of the platform. These may include verification emails, password reset messages, registration confirmations, event updates, waitlist notices, reminders, account notices, security messages, and nearby-event alerts that you voluntarily enable.

Marketing messages, newsletters, or promotional notices may be subject to separate consent choices where required by law.

11. Check-In, QR Codes, and Attendance Records

The platform may generate QR codes, signoff tools, attendance statuses, and related check-in or results workflows for operational event use. Users must not tamper with check-in records, forge attendance, misuse QR links, or attempt to alter results or session status improperly. We may correct, restrict, or invalidate records where misuse, error, or fraud is suspected.

12. Gameplay Statistics, Rankings, and Public Features

The platform may display game history, table results, rankings, leaderboards, or participation statistics. Some data may be public or visible to other users based on the feature design and user choices. Other data may be private or internal-only.

We do not guarantee uninterrupted availability, accuracy, permanence, or ranking outcome for these features, and we may adjust scoring, display, eligibility, or related logic as the platform evolves.

13. Intellectual Property

The platform, including its software, design, layout, branding, logos, code, text, graphics, workflows, and non-user content, is owned by us or our licensors and is protected by intellectual property law.

Except as expressly allowed by law or by written permission, you may not reproduce, modify, distribute, sell, reverse engineer, frame, mirror, republish, or create derivative works from the platform or its protected elements.

14. Third-Party Services and External Content

The platform may use or link to third-party services, including payment providers, email tools, hosting vendors, map/geocoding services, social media services, venue links, or other external systems. We do not control those third parties and are not responsible for their services, availability, conduct, terms, content, or privacy practices.

15. Privacy

Our handling of personal information is described in the Privacy Policy applicable to the platform. By using the site, you acknowledge that your personal information may be collected, used, disclosed, and stored as described in that Privacy Policy.

16. Suspension, Restriction, and Termination

We may suspend, limit, or terminate access to the platform, an event, an account, or a specific feature at any time where we believe it is reasonably necessary for security, legal compliance, operational integrity, moderation, abuse prevention, payment enforcement, technical maintenance, or investigation of suspected violations.

17. Availability and Service Changes

We may modify, suspend, discontinue, replace, or update any part of the platform at any time. We do not guarantee uninterrupted or error-free access and are not responsible for downtime, maintenance windows, vendor outages, connectivity issues, mapping or email failures, or other service interruptions beyond our reasonable control.

18. Disclaimers

The platform is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the platform will always be uninterrupted, secure, accurate, complete, current, or suitable for every purpose.

We do not guarantee the quality, legality, safety, conduct, attendance level, success, or outcome of user-created events, nor do we guarantee that any specific participant, organizer, venue, or third-party service will perform as expected.

19. Limitation of Liability

To the maximum extent permitted by law, BoardGamesNMore Inc., BoardGameNite, and their directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or loss-of-profit damages arising out of or relating to the platform, the use or inability to use the platform, any event, user conduct, third-party services, data loss, downtime, security incidents, or content issues, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the platform will be limited to the greater of: (a) the amount you paid to us directly through the platform for the specific service giving rise to the claim during the 12 months before the event giving rise to the claim; or (b) CAD $100.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply in all cases.

20. Indemnity

You agree to defend, indemnify, and hold harmless BoardGamesNMore Inc., BoardGameNite, and their directors, officers, employees, contractors, affiliates, licensors, and service providers from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to your content, your events, your misuse of the platform, your violation of these Terms, your violation of law, or your infringement of another person's rights.

21. Governing Law and Disputes

These Terms are governed by the laws of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to any rights required by consumer protection law, the courts located in Quebec, Canada will have exclusive jurisdiction over disputes arising from or relating to the platform or these Terms.

If you want arbitration, mediation, class action waiver language, or consumer-specific exceptions, those should be added only after legal review.

22. Changes to These Terms

We may update these Terms from time to time. When we do, we may revise the date at the top of the document, post a notice on the site, or provide account or email notice where appropriate. Continued use of the platform after updated Terms become effective means the updated Terms will apply to your future use, except where law requires additional consent.
