Terms and Conditions
1. Acceptance of Terms
By accessing or using BoardGameNite, creating an account, registering for an event, creating a Quick Play Setup or user-created event, activating a subscription, or using SMS/OTP services, you agree to these Terms and Conditions and the Privacy Policy. Certain services may require explicit acceptance of the current terms before activation or confirmation.
2. User Roles and Current User-Focused Workflows
Users are responsible for accurate account information and for maintaining account security. BoardGameNite may provide standard user, Client Lite, Client-Flex, Client Pro, Client Elite, Planner, Manager, Administrator, Designer, and Venue Partner roles or subscription tiers. A standard user account may not charge event fees or ticketing fees unless upgraded or authorized under the applicable tier and platform rules. Subscription family rules may limit self-service switching between Client/Planner, Venue Partner, and Designer account families.
3. Subscriptions, Payment Agreement, and Billing
Subscription and payment details are governed by these Terms and Conditions and the separate BoardGameNite Subscription and Payment Terms, which are incorporated by reference and repeated at the point of checkout or activation on the Account Subscriptions page. The platform requires acceptance before a subscription service is activated or a Stripe checkout session is started of the Terms of Service, Privacy Policy, and Subscription and Payment Terms. Subscription details may include plan name, price, billing interval, taxes or processor fees where applicable, available features, account limits, free-trial period where configured, payment-method collection before checkout confirmation, renewal behavior, cancellation process, failed-payment grace period, account freeze and public event delisting after grace expiry, 30-day notice rules where configured, and provider terms.
Recurring paid subscriptions other than Client-Flex may begin with a configurable free trial; when a trial is offered, billing starts automatically after the trial unless the subscription is cancelled under the applicable rules. A valid payment method is collected during checkout. If a recurring renewal payment fails, email notification is sent and the account remains active for the configured grace period. After that grace period, the subscription account may be frozen and owned events may no longer be listed publicly until payment is restored. Client-Flex is not a recurring monthly subscription and is excluded from trial-to-paid and monthly renewal billing.
Only one active subscription can exist per account unless an administrator explicitly approves otherwise.
Client-Flex is a usage-based Client tier with no fixed monthly subscription charge and no free-trial period. Activation requires acceptance of the current legal terms and successful Stripe payment-method verification. Stripe Checkout setup mode and a SetupIntent confirm that the applicant supplied a valid card and securely save the payment method without creating an activation charge or fixed monthly subscription charge. This payment-method verification does not independently verify a person's identity. A bank or card issuer may display a temporary verification authorization; it is not a completed BoardGameNite charge and is released according to the issuer's timing. The first five paid ticket units for the Client-Flex account in each calendar month are exempt from the 10% ticket-sales platform commission starting immediately on activation. The allowance resets at the beginning of every calendar month. The 5% ticket-processing fee applies to every paid ticket checkout, including allowance tickets. Multi-seat purchases count once per paid ticket unit, not once per checkout. Refunds, cancellations, and chargebacks may reverse or adjust related fees and commissions.
4. SMS, OTP, and Communications
Where SMS is enabled, you may receive one-time password messages, account-security notices, event reminders, registration updates, subscription notices, or operational alerts. SMS consent and notification preferences may be managed in account settings where available. Message and data rates may apply. SMS delivery is not guaranteed and may depend on carriers, device settings, and the SMS provider. Some transactional or security notices are necessary to operate the platform and may not be fully disabled.
5. Event Registration, Ticket Terms, and Refund Cutoff
Ticket terms: unregister and refund/credit eligibility are available only until the refund cutoff. Refund eligibility is null and void beginning 12 hours before the event start time. After that cutoff, attendee self-unregistration is unavailable for event tickets and cash refund or credit requests may be denied. Approved cash refunds are provided at 95%. The remaining 5% is withheld for processing and administrative costs where permitted. Approved platform credit is provided at 100%.
6. Payments, Refunds, Credits, Waivers, and Seat Holds
Paid event registrations, event-level packages, deposits, comped/waived seats, late invites, and platform credits are subject to platform rules and event-specific terms. A waived or comped registration is treated as paid only according to platform records and does not mean money was collected. Comped invitations sent by a Planner through friend, direct-email, or late-invite workflows may require a reason and may be recorded in an immutable audit, reported to the assigned Manager, and included in anti-circumvention review. Comped registrations do not consume Client-Flex monthly free-ticket units and may not be used to avoid platform fees. Payment processor terms may also apply.
7. Quick Play Setup and User-Created Events
Users may create Quick Play Setup and user-created events where permitted. Event creators are responsible for accurate titles, times, locations, table capacity, visibility, registration settings, schedule details, participant communications, and lawful operation. BoardGamesNMore Inc. may remove or modify events for safety, abuse prevention, legal compliance, or operational reasons.
8. Friends Lists, Invitations, and Social Features
Friend requests, accepted friends, friend groups, invitation controls, blocking, and visibility choices must be used lawfully and respectfully. Users may not spam invitations, impersonate others, harass users, bypass visibility controls, or misuse friend attendance information.
9. Scoring, Community Score, and Reliability Score
Scoring features may include score submission, approval, disputes, corrections, validated results, Player History, leaderboards, Community Score, and Reliability Score. Leaderboard and reliability features are community-recognition tools and do not represent cash value, prizes, or guaranteed status. Prize and promotion eligibility may depend on verified completed games, the quality and integrity of recorded play, accurate attendance and scoring information, and the rules published for the applicable promotion.
10. Prize, Promotion, and Leaderboard Integrity
Eligibility for prizes, promotions, raffles, coupons, rankings, and other benefits is subject to verification of completed games, the quality and integrity of recorded play, accurate attendance and scoring information, and compliance with the applicable official rules. Awards remain subject to the reasonable discretion of BoardGamesNMore Inc. based on the verified games and quality of play recorded for the promotion.
BoardGamesNMore Inc. may investigate suspected cheating, collusion, duplicate or false accounts, fabricated games, false check-ins, manipulated scores, inaccurate event or game information, misleading submissions, or other abuse. Where reasonably supported by the available information, BoardGamesNMore Inc. may correct records, remove eligibility, disqualify an entry, withhold or cancel a prize or benefit, select another eligible recipient, suspend or restrict an account, or take another proportionate action permitted by the applicable rules and law. Promotion-specific terms govern prize quantity and approximate value, eligibility area, opening and closing dates, selection method, tie-breaking, verification, delivery, and other material conditions.
11. Late Player Score Access
Late Player Score Access, late invites, waived/comped late registration, and score-only workflows are operational tools. They do not remove organizer responsibility for accurate attendance, table setup, communications, and payment-status accuracy.
12. Acceptable Use and User Conduct
You must use the platform lawfully and respectfully. You may not harass, threaten, defame, discriminate unlawfully, exploit minors, post illegal or harmful content, upload malware, interfere with security, scrape data, reverse engineer restricted parts of the platform, bypass access controls, spam invitations, manipulate scores, abuse reports, or use the platform for purposes unrelated to lawful board-game/community event activity.
13. Reporting, Moderation, Ban, Deactivation, and Deletion
Users may report problematic users, events, content, scoring issues, or rule violations. We may review, hide, remove, restrict, suspend, ban, deactivate, reactivate, delete, or otherwise moderate accounts, events, registrations, scores, invitations, friend interactions, reports, or content where reasonably necessary for safety, legal compliance, operational integrity, abuse prevention, payment enforcement, technical security, or investigation of suspected violations.
14. Platform Availability and Changes
We may modify, suspend, or discontinue features, pages, events, policies, subscriptions, plans, prices, or the platform as needed for security, operations, legal compliance, product improvement, or business reasons. We do not guarantee uninterrupted or error-free service.
15. Disclaimers and Limitation of Liability
The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee event attendance, venue availability, game outcomes, organizer conduct, user conduct, leaderboard accuracy before validation, subscription provider availability, SMS delivery, or uninterrupted platform availability.
16. Governing Law and Venue
These Terms are governed by the laws of Quebec and the applicable laws of Canada. The courts located in Quebec, Canada will have exclusive jurisdiction over disputes, subject to any mandatory consumer-protection rule that cannot be waived.
